The supreme court has adopted its first code of ethics after a series of news story's documenting sitting justices accepting lavish gifts from republic and donors.
The new ethics rules are similar to those already apply to lower court judges, except they are missing one important feature only someone went for. Some were .

So we're going to get into the lack of an enforcement mechanism. But first, if you could just tell us what this code atis actually says.
sure. So the code itself runs about nine pages and IT IT covers a range of topics from when a justice has to recuse himself or herself from a case, for example, when they might have a financial stake in the outcome, uh to a prohibition on solicitating gifts uh to a sort of more uh general principles like the fact that the justice should not engage in in political activity, although that term is not defined, that the code .
so if there isn't a way to enforce this, then why would justice is follow IT?
It's a good question. I mean, it's sort of the honor system. I mean, judges and another legal observers we talked to said this is significant because, uh, lower court judges for for a century now i've had uh some sort of written ethics codes for having something explicit in writing that the the meeting yeah the public can look at and and measure justices conduct against uh, is meaningful even though as you said, there's no actual a way to enforce IT that's laid out in the code.
Now this is all happening because of accountability reporting that republican and others did on justice Clairs Thomas simula fAiling to disclose expensive gifts from benefactors. Would something have been different if these rules existed before?
It's a good question in in some ways no because there there is a separate federal law that this does not change that requires justices to report most gifts and what we reported that justice Thomas leader had failed to follow that law by not just closing these gifts um in other cases, this code could come in to play we reported, for example, that uh justice Thomas was flown a few years ago to be the speaker at at a fundraiser for uh the coke political network of groups the question would be, well, this code of conduct says justices can't engage in political activity and you know, to a lot of people are speaking at a funders of political group would count as political activity so and then the question would be, well, who determines whether justice omas violated the code and and you know, as I mentioned, code is silent on that question okay.
So the U. S. Senate continues to investigate ethical lapses on the court, and congress could still pass ethics legislation if democrats get their way. Does the adoption of this new code ethics have any impact on any of those efforts?
Yet we're still watching what's happening at the senate year committee. H senate democrats have a been talking about issuing sap as to some of justice Thomas benefactor s to try to get the full picture on gifts and they have not said they're backing down.

So you mentioned a lot of problems. Do the scientists who wrote this report offer any solutions?
They don't prescribe specific policies, but they do lay out some facts like addressing climate change can make the U. S. A fair, our place to live.
So for example, right now, if you're poor or if you're not poor, but your black or hispanic, a indigenous, you're more likely to live in a place with polluted air. And as we move away from fossil fuels, that means that less air pollution. So two birds once stone. But concrete policy decisions, they're really up to people with power right now.
