And since then, so much has changed for everyone. Firstly, we now know this is no longer a missing person's case. Two men who reformer students of terrorists now face charges in relation to her murder.

In on top of that, there's a gag order in place in today's episode. I want to revisit teres case and reflect on all the changes between then and now. Two thousand years later.

As soon as I heard the news about both, duke news is charges. The first person I talked to was philately away since the last episode. Open advantage. There has been some recent updates in the case regarding both ducks. If you want to elaborate on that a little bit, that be great.

There really has been a big development because in August of twenty seventeen, a grand jury in wilcox county, georgia, edited by dux ford, additional felonies, making a fault t statement, hindering apprehensions of a criminal, concealing the death another.

The endangered is structured in a weird way, because IT charged him with two counts of making a fault statement, one count of hindering apprehension of a criminal, and one count of concealing a death of another. And the problem with that is, is that this all supposedly had happened in june of twenty sixteen in world cox canny, allegedly he's basically being accused of lying to agent shadow in june of twenty sixteen. So was he on the radar before twenty seventeen? Obviously at least bow was.

And what they are accusing him of is lying about his role in the death of terrible rested. This new indictment deals with a conversation supposedly had between agent shadow of the gbr, and both dukes and IT deals with lying about a conversation or information that so discussed with someone by the name of john makola that's listed in count one specifically, he says he did not to agent agent shadow that he did not discuss terra Greens dead with john makola. Now the double negative is not withstanding.

IT doesn't go into much detail about how that was untruthful, but IT is almost as a false statement. When we went into this case, there seem to be no doubt that bow was gonna the singer piece of the trial, the state of georgia versus ryan Alexander do and that his testimony, him coming forward, that was sort of the big break in the case, because until early twenty seventeen, none of us was on their radar, or at least ryan wasn't on their radar. But interestingly enough, we start talking about statutes of limitation and whether or not there was a search of the peak in ordered made by iron canny back in the months following terrors disappearance.

And the question is raised in up, vanished and other places, quite Frankly, about whether or not there was a problem with the statute of limitations. I don't think the da can use both dux as a witness at all in the case, because if he is being accused by the same investigative agency of being a liar, there's no way that he can be a witness in this case because once his as sits in the witness chair, his credibility becomes an issue and if he's being accused of all these families and families that involve truthfulness, there's no way that they can prosecute this case using bow as a witness at this point so if possible, on is going to convict ryan. He's going to have to do IT with other colaba ating information and he's going to need to leave bow completely .

out of IT is IT possible to get a conviction of ryan duke for terrorist murder without any other witnesses?

Well, they have presumably some statements made by ryan. They have presumably physical evidence that was obtained from the peak and orchard following the GPS search. Exactly what that is, I don't know, but they do require some CoOperation if ryan has made any incriminating statements.

And then we also have to ask ourselves, who else might be on their witness list? Who else might they have talked to after they interviewed boo dukes? Where in this case does this john mccolo come in and who is he? What statements might bow have made to john makola because the wilcox caney endangered really brings this person and as a new player. And the gba is alleging that bow has made statements and had a conversation with john makola about what happened.

But still, if what's in question is both truthfulness, if he told somebody else something about what happened to terra or what ryan did, he could also be lying there too, if somebody else, one of those friends or former friends, or army bodies, or whoever IT is, is testifying about something that boat told them. I mean, isn't that not credible too? I mean, sounds to me like I would be the same thing.

Essentially that only is IT possibly not credible. It's also here say you can't just bring in a john mccollum and say, okay, john, we could till this jury what bow said to you because that's here, say, because bow would not be there and then be subject across examination.

So in bringing this new entitled against bow and what cox counting IT really moves the waters when we're thinking about how this case is going to be tried, who are they going to use as witnesses? Obviously, they can use any statement that ryan makes. They can use any CoOperating physical evidence that they might have.

They can bring any other witnesses who have direct knowledge of anything about the case, but they cannot bring in people to testify to hearsay. And given what's happened at this point, I don't seem a real way to bring both dukes in as a witness because the state of georgia is accusing him of being someone who is not trustworthy. Or to put in another way, the state George says this guy is not worthy of belief. But hey, Jerry, why would you believe him in this case? So IT doesn't make sense, doesn't make sense why they would use them at all.

think that there might be a scenario possible where they obviously tried to convict both of these guys. Ryan duke, for the murder of chagrins, said in boat dukes for helping cover IT up and all the lies he's told, let's say, would IT be possible that they do not have enough evidence to convict ryan of the murder, but they still can convict both dukes for what he did because he actually admitted IT and they were able to collaborate this story by finding the body.

That's absolutely possible. I think that given the fact that there's two indictments against both, granted that one of them may have a statute limitations defense, the fact that we've edited boat twice in two different counties within the same judicial circuit tells me that they are trying to convict bow and probably trying to send him to prison. You ve got a bear and man.

The endangered against ryan is in the tiff judicial circuit in an entirely different county. So the evidence that one would use to try to prosecute bow is entirely different than the evidence that would be used to go after ryan, or at least partially different. There may be some overlap, but these are all three distinctly different .

environments. I see it's been over eight months now since the arrest, and we're approaching nine months, slowly approaching a year since the U. S.

What kind of time eline we look at here? I know that these things can take a while. This is a very complex case, the biggest case file in the history of the gb. I. But are we any closer then? We were at the end of the season.

If you're talking about how close we are to trial, they're keeping this very close to the vest. But given what we know about how fast things work in iron county and how quickly cases go to trial, this case is not yet on the radar for trial. IT seems that there's a lot that needs to be done.

The supreme court is still considering the gag order in the case. It's not impossible that the da might want to go here and get the case trade before the supreme court even rules on the case, which would render that mood. But it's still are when calling and reread sty telling us about people that sit in that jail for two to three years without going to trial. IT would not surprise me if that's not where we are here that we're just in a very long holding pattern waiting for trial.

I know it's iron county and things move slowly and differently. Down there is a small town, and some of the rules seem like they don't apply down there. But this is a national story. Now this is a huge case that has eyeballs on IT from all over the country. Shouldn't that make a difference in the way they move?

In this case, IT should make a difference because they say justice delayed is just as denied. There is something that the defense could do at this point. They could file what's called a plea in bar, and they could say, you know, judge IT would be unconstitional tional to try this case because of pretrial delay. Our client has been sitting in jail awaiting a trial for so long that our ability to present the defense has been happened to the point that is violated his constitutional right to a speedy trial. Now that's often times a high burden, but I think we're approaching the point where a prudent defense council might at least have to consider asking a judge to dismiss an enduring cement based on pre trial delay.

And what do you think the judge said of that?

I can tell you that those types of motions are killed and granted, at least by trial courts, the way that people win when they do win on such a motion is IT gets denied by a trial court, and then that gets reversed by an a pellet court. But it's not beyond the realm of possibility that judge cross could saying, you know what, IT has been too long and that your constitutional rights are violated and they would dismiss the endangerment. The biggest change between the end of season one and now the legal perspective is that I am fairly certain that bodog will not be a witness if there's ever a trial in the state of georgia verses ryan Alexander duke.

I think that that kind of bring age. All of this is A A presumption, but you cannot yet a fair and impartial jury. And what is IT right now to say that you can't get a, in your opinion, a fair or the opinion on me I fair and impartial jury. What indication do we hail?

We're concerned you, as stated by the different things that are in the articles we are having problems with with the social media in the internet is being what IT is today. We can look at those things and see, and we're seeing and it's been thought, and I know just because body post anything doesn't mean they're potential jury that could be on the side of the world.

But when you see the vum, the the hatred, the concern that goes to our client IT, doesn't us very concerned. One of the things that you may notice from the facts in this particular case there is an internet website has been devoted to this case, open, vanished, and I SAT on there. There's personally fifty million listeners on there.

And if you look at mr.

Linsey coverage of of the trial onest i'm sorry the coverage of the case, you see that um even without going into the the details on the things that we asked not to be discussed, he's still labor grab media coverage and talk about the case. Is that prejudice potentially in some cases .

You still think that prejudice? Or could all we based is that the gag order to covered the potential trial participants, but you can't trace the what the trial participants are doing in an inappropriate way to the stuff you're complaining about this podcast. Is there any evidence the podcast is based on anything that this order would prohibit? Not we could tell we monitor just is. So if that's the case, how can you cite that as basis for the gal? Well, they work around IT.

They're able to cover .

IT without getting into those potential facts that are we consider will be prejudicial to the case. The potential jurors, yes, we call that media coverage right. Are are you saying that the cork can ban media coverage based on what they learn through the public? No, I don't think this guy go to profit them from being prohibit, from being able cover the case.

I think what IT does that limits maybe what they want to get in to the sorted details, the kind of things that typically we would get into in a trial of the case. But I don't think IT limits their beauty to to make a fair coverage of the case and inform the public of the progress and what's going on on and what evidence are they getting in disorder. Ted details that cover from anybody come from anybody cover about this order? Well, they're going to come from long fortson. And that's why what what evidence is there in the record that anything that you call a sorted detail is coming from something that would be prohibited by this order. Your own phillip lowe had his own opinion on the gag order. Two, there's also been some recent developments in the news regarding the gag order in this case. Could you library on that?

Or october twenty fourth of twenty seventeen, the Georgeous supreme court man and heard the appeal that was filed by media lawyers alleging that the gag order violated the first a moment. And if you watched as added and listen to the justice questions to the lawyers for both sides, IT seemed like that the justices generally were concerned about how broad this gag order is and whether not, in fact, has hampered the news media y's ability to together information, because the first mimi deals with many things. But at the heart of this appeal by the media outlets is the right of the press to have free access to the ability together the news, if you will, the arguments that were made by the lawyers for every sad in this case were certainly very interesting. But looking at IT objectively, if our to be a voting justice, I would have voted with the media lawyers, because I think, in my opinion, they have the Better argument when IT comes to the legality of the gg.

Just like I mentioned in the podcast before, in the past, in the courtroom that day, the defence council for ryan duke and the district attorney y who is prosecuting ryan duke, were both sitting at the same table once again, and they were there in support of the gag order. Why do you think that is .

both sides of this case, the prosecution and the defense very much want this gag order to remain in place. I can see why the defensive would be supporting a gag order because they're trying to avoid a tainted jury pool. The prosecution also is interested in maintaining the integrity of an investigation, and not have wild theories and speculation and rumor make their way out into the media.

So both sides do have sort of parallel interest here. But the problem with both of those arguments is that there are other remedies. A police chief or the director of the gba could simply issue in order and say, look, nobody who works for me is allowed to talk about this case, and if you do, i'm gona fire you.

So that has just as much effect, if you will, ls a judges or, and as far as a fair trial for the defense, there are lots of other things that would work. And I really don't know why anyone would even conceive of having a trial, in this case in erin cali, because IT has literally permited and saturated the discussion in that county since terror up advanced ed, I think that a change of venue almost has to occur. And that would be the best remedy against the tainted jury pool, not some gag order that IT has brought, as this one is .

with the way reporting has changed in recent years with technology, social media, twitter, podcasts, all that stuff. This to me seems like IT could be an even bigger deal than IT is now because the defense is bring in this podcast, which is a generally new form of reporting and journalism. That's only about ten years old if that, and they're basically saying in some way or another that they do not want me and this podcast to be able to report like I have been on this case. And I feel like if the supreme court rules in favor of removing the gag order and supporting the first amendment for people like me who make podcast about true crime stories, I think it's a huge step for when IT comes to other people who wanted do what i'm doing years from now. I don't know of any other case that's been in the supreme court that is regarding the first amenity in a podcast, and I feel like this could set a precedent for what to expect for other podcasts ers in the future.

Well, I think there was a ruling recently by the Georgeous supreme court where another pod he I think was undisclosed when to access to some audiovox a trial and the court, in a very technical ruling that had nothing to do with the first minute IT said that IT was trial recordings were part of the record. But there was no right that the a podcast had to force mile to give over the audio of of a trial.

But sure of that, this is absolutely a major development in not only the recognition of what podcasting can do because we have the ability to reach audiences that are much wider, then the media outlets that brought this chAllenge to the gager, I mean, hundreds of millions of of license worldwide versus the media market for a local atlantic TV station is huge. So you now have the up vanished, this one little podcast that you started out of your apartment now becoming sinter stage before the Georgeous supreme court. And is there because somebody had the where with all to go down to the small town and they didn't know anything about that and just start asking questions and the questions, that's what shook the trees that caused people to talk.

You know, you shake enough trees. Leaves are going to fall. Not you're going to fall.

You're going to learn some information and that's what happened. Things get stir up to the point that people started talking. So the podcast is absolutely made a difference. And IT has the possibility to make really, really good case law depending on how the supreme court rules.

The other thing that you got to taking to consideration is that the podcast has not necessarily been in lockstep with the narrative that has been presented through the warrants in the indictment. We have questioned a lot of things about this case. We've talked all along about that.

We want IT. We want the case to be solved that we want the truth to come out. We don't want some partial truth and we don't want some fake truth.

So we want IT solved. They're claiming that is solved. And we have openly questioned whether theyve got IT right. There's definitely been a sort of a love hate relationship over the over time. And it's changed over time because when this arrest took place in these indictments occurred immediately, we started looking at and say, and wait a minute, something about this may not exactly make sense based on what we know.

So when IT comes to the supreme court ruling on the gag order.

what happens next? What what happened would be the supreme court would either say that the gag order was not unconstitional tional, and that would stay in place as IT currently is, or they could say part of IT is constitutional, part of its not, and send IT back to the trial court with instructions to make appropriate modifications based on what the supreme court mayor may not found to be unlawful about IT.

So when shall we expect to hear .

their decision? The supreme court usually takes several months, depending on whether not the justices or an agreement. One interesting, sad. Now, the georgia supreme court now has none members on IT. One of the members of the supreme court recused herself from the deliberations because of some political connections that he has to.

One of the lawyers who did not directly represent the media, but also found what's called in the megas brief, which is sort of like a third party intervening, saying, yes, we don't represent this TV station, but we agree with them. So because of some connections that were personal or political between one of the justices, there was only eight. So I could turn out that there is a tie. And if there's a tie, the ruling stands as is and the gag order stays in place.

Besides legal developments, there has recently been some personal and emotional changes in tears case dusty vsi passed away on september eighth, two thousand seventeen, from cancer. Dusty was a huge help to me during my investigation, not to mention a real friend. And i'm not just saying that out of every single person I met in this case, I was closest to dusty in the osla star.

Where he worked was really the only place I ever felt comfortable. does. He was smart, he was witty, he was funny and hands down, one of the most genuine people i've ever met, and not to mention an incredible writer, all miss him in this case, would not be worried today without his help recently, does he? His mom called me to share some words of her own about her son.

He was, get ready to go to on, ready to get statements from anybody, because that was when they hit, just got charged with the other enveloped in workup, counting the line to the dvr. He was getting ready to get there. And he called me in, and the and I was there before.

The end was he had started cough in blood up again, like he did at first. But we got to the hospital to you or make IT get again in. And one of his doctors is my poll. Melodist thought that he had a leak come in from an order in the radiologist rated and said that IT was a blood clot. So we don't really know for sure what I supply, but IT pretty much stopped during the day.

It's just a little bit her name and his sister had come from by the americana and he had been there maybe five, ten month and you know that yeah you cut up and i'm not sure I know what the man of the song was. He had on a long sweater, but he had on genes, but something about a short skirt, long ter, and anyway, he was saying in that there, and this typical self, and I been try to be funny, and it's not really gotten. And when he started copy, he started again, and IT never stopped.

Thank you. But expected that that happen. nothing. He wanted to ride the bonita and what he said, but he wanted to write IT from the towns aspect and let everybody know that.

I'm very, very proud my son. He always has been, even as a child, probably the most honest person. I mean, he would tell him himself when he didn't not do what.

I never found out he was a good, but that's the way you was. He was an open book, you know, believe me, you thinking as and the people and I still were trying to to hide things he would have brought out. IT would have like a secret like that go for twelve years if IT was well now they just written.

And I hope there will be just as a there a. And I hope that the right people, robbyn, will be prosecuted for the right ground. SHE deserves that justice.
