what's going on everybody i'm mara and i'm tez and welcome back to sisters who kill all right y'all this one is a tearjerker you have been warmed all righty let's start off with our players first we have twyla austin this is desire's mom we have desire mays

our victim and Lysinthia Tidmore, our murderess. This week's story takes place in Ohio in 2017 on a day that started just like any other day. But this day was extremely special for nine-year-old third grade student Desire Mays.

You know, like, stop, look, listen.

Look left, look right, look left again. All of that good stuff. Safety. She learned about the crosswalk and all the ways that she was supposed to stay safe outside. But today was the day that she had been waiting for. Today, November 9th, 2017, was her first day crossing the street all by herself. Finally, she was able to do it. And like, I remember like the times that my mom would let me do things on my own for once. And I'm like, yes.

Like I'm kind of a big deal. I'm kind of grown and I'm sure she was really excited. That same day, LaCynthia Tidmore was driving to work. Now, LaCynthia was a 23-year-old single mom also from Cleveland. Though she was driving her car to work, she actually was not even permitted to drive by the state because her license had been suspended and she didn't have any insurance on the vehicle. Anywho, she's headed to work and she's driving down Babbitt Road at 7 a.m.

At this same time, Desire looks left, looks right, looks left again, and heads across the street. Little did Desire know that LaCynthia was driving down this same street at the same time. LaCynthia had no idea that Desire was there either because her eyes were not on the road. Instead, her eyes were looking down at her phone, texting. She was so distracted she didn't even hear the car behind her blowing a horn trying to warn her of the tragedy to come.

She was so distracted by her cell phone that when she hit Desire Maze, who only weighed 70 pounds, she smacked the windshield, rolled up it and off the back of the car, and Lucinthia was completely unaware.

Lucinthia then just drives away from the scene. She claims that she thought that she only had a traffic cone. But little Desire was left laying on the street. Every bone in her face was broken. Both of her femurs were broken. All of her teeth were knocked out. Her chin was split open and her neck was broken as well. Her mom was left to see her child in the most unimaginable way.

911 was called and little Desire was quickly rushed to the hospital with her mom in tow. The vehicle that just left her daughter in this tragic state was nowhere to be found. And it got really bad that Desire is pretty much pronounced dead at the scene. But according to her mom, they gave her like a shot to make her heart start beating again and then had her own life support.

And she was on life support for a total of 15 days. I'm sure she was unrecognizable. Her mom said her eyes were bulging out of her head. I could not imagine. It was enough seeing my dog hit on the side of the road to be a whole human child. And my child. My child. And then the person that did this is gone. Because I'm sure she's headed towards the hospital. She doesn't know who is there.

So, I'm sure you're wondering the same thing we were wondering. How do you hit a child and not notice? Right. After this collision, she lost a tire and her bumper was hanging off her car. She continued to drive her car down the street to the gas station. Talked to the clerk like, yeah, girl, I done hit a traffic cone or something and I'm towing my car up. And she's like, yeah, so, you know, do me a favor and, you know, don't call no police to come tow it or nothing. I'm going to come back for it later.

What? Your car is messed up. You think nobody's going to notice it? I don't know that she cared that anybody noticed it. Because, you know, as far as she's concerned, she just hit a traffic cone. It's more of a matter of... You can't be that dense. While she's up there kicking, she called her mom to come get her and take her to work. Some sources say just a relative. We found one that said a mom. So she took her happy jackass to work.

she never once looked at her car and all the damage and said damn i should go back and see what the fuck i hid that got my car like this instead she decided to go to work now thankfully a good samaritan saw what happened and followed lucinthia's car to the gas station and called the police which is like the right thing to do i do not being i'm like please don't get an accident in front of me because i'm gonna have to pull over i'm gonna have to be a good samaritan and if i see something like this

I gotta go find I gotta go either check and see if the baby is okay or chase you down because you done left the scene of the crime you chasing niggas down I didn't say he this Samaritan didn't chase her down right followed her so let me rephrase let me rephrase follow you to get your license plate to make because you just hit a baby I mean at this level I would involve myself but I'm

I've been on both sides of a traffic accident. And now while when I'm in the right, you know, side of things, I appreciate the good Samaritan. But when you're in the wrong side of things. You can go mind your business. I've also never hit a person. After a person calls the police, they obviously come and process the car. And LaCynthia pretty much had no choice but to turn herself in.

As soon as she clocked out of work. Which is like, why didn't they pick her? They knew it was her car. That's why. Somebody... Was the car also not registered? Because... So, they say that she turned herself in because she got reported or whatever. But maybe they just issued a warrant. Right? So, maybe they just issued a warrant. They're not coming to track you down. She has not been officially pronounced dead yet. Right? Right. She sure hasn't. So...

Maybe they were just like, okay, if y'all see LaCynthia, pick her up. Yeah, let her know. She just called and arranged her surrender. So, she turns herself in that evening, and she's arrested for vehicular homicide and leaving a crime scene. Her bail was set at $5,000, which her folks quickly paid, because, you know, you only pay like 10%. Yeah, she only had to pay like $500. And she was free until she had her day in court. This is how you know...

That this is traffic shit. Now Cynthia is back home and she's back to living her normal life. She's back to posting on Instagram, hanging out with her boyfriend, hanging out with her sister, and getting ready for trial. And the Monday before trial, allegedly, because it's never got played out in a court of law,

Mm-hmm. That's all I'm going to say about that. So the Monday before trial, LaCynthia runs into Miss Twyla Austin. Now, this is, remember, is Desire's mom. And LaCynthia starts yelling herself out at her, like, obscene things is what they were saying. Yelling herself out at Desire's mom. And then they come by and they physically assault her to the point where she has a bruise on her face in court. Isn't that crazy? Yeah.

Right before court, you gonna try and beat this lady ass? And laugh to her face. Like you ain't kill her daughter? I don't understand. How does that work? Make it make sense. So finally, on May 24th, 2018, she had her day in court. She already decided that she would plead guilty to the two charges. So there wasn't much of a trial. No evidence was presented. No jury. No finger pointing.

But her mom and the community that helped raise her got their day to talk about desire, express their grief, and give in detail how painful it was to see desire after being ran down by LaCynthia. And I raised my daughter for eight years by myself.

With the support of these people that you seek. These are not just people just coming out the woodwork. These are people who know Desire, who loves Desire, who was in her life. She had nine birthdays and my cousin was at every last birthday. And then y'all, well, Cynthia gets to say her piece, you know, her apologies to the family and her apologies to the court.

And I'm just going to let y'all... I didn't even want to hear what she had to say because she looks so fed up. Y'all, you have to watch it. It's on YouTube. She looks... She has the nastiest attitude. She looked like everybody was there wasting her time and she could not wait to get it over with. And when she finally got something to say, this is what she said. Well...

I'm sorry that everything happened how it happened. Like, I regret the day. I wish I could go back and redo it if I could. I mean, I'm sorry about the life that I took. And it hasn't just changed the family life, but it changed my life, like, completely. It's like I'm really, really, really sorry about everything, like, everything. It's some things that I wish I could have.

Could go back and redo differently. And I'm truly sorry. All right. That's right. Thank you, Your Honor. It's the, I am really, really, really sorry for me. Like, you better find some better fucking words.

You better dig a little bit deeper into your heart to express the grief that you had for killing my child. She didn't write that down. And she's rocking from side to side. She's looking like I could care fucking less. You can tell she put no thought into this about how she was going to address the family. And I know some people wing it. People who wing it are good with words. You are not. Right. She just, it's like she didn't even give a shit. It really is. Like from here and then the rest of the proceedings just did not give a fuck.

Everybody was wasting her time, clearly. And, like, she had some place to be. Yes, prison. That's where you have to be. So then, what, her great aunt speaks, and she is talking about how she... Her great aunt is actually the one who was friends with the clerk at the store. Right, and this clerk had no idea that...

When LaCynthia came in, that Desire was dead or anything like that. Of course she, why would she know? Right. And just to know that you were just like, ha ha ha. And she was smiling up in your face after she just. Right. She was like, girl, we came in here. We joked. She asked me not to tow her car. Like. And I seen, you know, the police showed up because the person, whomever it was, the Good Samaritan followed. A mess. Then, um, who was the next person? Her aunt spoke. Her regular aunt.

Yes, then her regular and spilled a little bit of tea. She knew that she hit a child. I was at the hospital that morning. I got a phone call at work. I left work to go to the hospital to be with her. She made a phone call to her family, her sister, knowingly that she hit Desire. And told her sister this. Knowingly went to work and called arrived to go to work.

I'm an only child, as we know. Tazzy, you have sisters. I have several. But if any of your sister called you and said, oh shit, I hit a child. My next question would be, and how is she? And what if she said, I don't know. What the fuck do you mean you don't know? That's not an acceptable answer. Then go and fucking find out. And call me when you find out and let me know what the fuck happened.

And I'm going to follow up, call you and be like, did you figure out what happened to that child?

But here's the part, y'all. Y'all have to watch this because something happens in the courtroom. The camera is on LaCynthia and on Auntie that's speaking. But when she says this, something happens in the courtroom and then somebody from LaCynthia's side left once this was being stated. But there was a little bit of a murmur. I don't know if it was some drama happening because LaCynthia definitely turned around to look. And the camera panned and followed her out like it was important. So I think there was some little...

Feathers ruffled. So I think the most heartbreaking testimony to listen to was, of course, her mom, right? And she gets on and she describes in detail how Desire's body looked when she got to the scene, which... I cried, y'all. Y'all know I cried. She cried every time we watched it, and we've watched it several times.

And I cry worse each time. And then she goes into... She also goes and talks about the altercation that she had with Lucinthia at the grocery store, pointing to the bruises on her face. She also, you know, kind of questions, you know, Lucinthia's character, which, I mean, as you should at this point, but she was like...

You didn't come to the hospital. You didn't try. Basically saying, you know, I had it in my heart to forgive you, but you have not done anything. Show me you didn't give a fuck about having my forgiveness at this point. Right. Like you didn't, you didn't turn around to see what you hit. When say your eyes were off the road, you had, that is it. Your bumper was gone and your tire was gone. And the girl hit your windshield and,

And you didn't, I know that car was making some noises. And there was only so, I would drive my car a good two feet, and if it get too loud, we're going to have to pull over and see what it is. Right, I'm not making it all the way to a gas station. And then her mom begins to, you know, talk about the days leading up and how she was preparing, desire to take this walk. Mm-hmm. Practiced this for a whole week. Now my daughter knew how to cross the streets.

week before this happened. This was the first day that I let her go anywhere by herself. This is what y'all don't understand the type of mother that I am. I stopped my life for my daughter and my whole life for my child. She was a good kid. Everybody that she crossed loved her.

I think that's the part that really got me. I know.

Like when she said it was her first time, like talking about, you know, the type of mother I am, I ain't let her go. So this was the first time she did something on her own. And it's like, ugh. You know, she's probably wrecked with guilt. She continued to say that, you know, she's been suicidal and it's just been so hard. How do you see that? I can't even imagine.

And then the person that did it is just over there looking like Boo Boo the motherfucking fool. Like, how do you... And trying to beat your ass about it. All right, y'all. Holistic is back. Five years in prison for vehicular homicide, which was the maximum penalty for that charge, and 36 months for count two, which was leaving a crime scene, which was also the max sentence. He said that she would serve these sentences consecutively, meaning one after the other, and not congruently, which means you can serve them at the same time. Mm-hmm. That's how we added up to eight years. So, not soon after...

Even though she had pled guilty and even though she'd been sentenced and all that is over. And she decided that she wanted to recant her guilty plea. Mm-hmm. She said she got bad legal advice. Right. So she said she had illegitimate counsel and she wasn't guilty after all. Because a lot of people tell you to plead guilty, especially if they usually ask you to do that, you know? So...

When that attempt didn't work, that wouldn't stop her. I just don't know why she felt like it would. You were on a suspended license, texting and driving, hit a nine-year-old child, did not stop, cost her her life, and then sat in court looking like you could give two shits. And then wondering why you're sitting in jail. Talk about something. This ain't right. Let me file an appeal. It's right. No, you all right. You all right.

doing just fine in there so that didn't stop her and in 2019 she tried to appeal her sentencing and not so much the guilty verdict because of course she pled guilty but saying that her sentences should not be served consecutively instead they should be served congruently and so and according to like straight up out of the court appeal document

It says, "In order to impose consecutive sentences, the trial court must find that, one, consecutive sentences are necessary to protect the public from future crime or to punish the offender. Two, consecutive sentences are not disproportionate to seriousness of the offender's conduct and to the danger the offender poses to the public. And three,

At least one of the following applies, which is a whole bunch of other stuff. But let's just go with one and two. I think that it's protecting the public to keep you there for consecutive terms. Because it's clear that you didn't care. They were also trying to say that because her mom got up and did that statement and talked about how they jumped her at the grocery store, that affected how the judge sentenced him. And the Supreme Court denied all of this. The state Supreme Court denied all of this. Said...

But this time he had to say on record that it was that he is taking those things into consideration. And it is just he had to go on record and say it's just and you have enough crimes to make this legal.

Because they also were saying she hardly had a criminal record. And it's because it's traffic. But that's not criminal. Well, I guess they said hardly had a record. And it's because it's... And I feel like this whole case was treated like...

Like a traffic accident. Like all the severities of a traffic accident. A $500 bill is not a murderous bill. Right. It's a traffic accident bill. And granted, she didn't wake up deciding that she wanted to kill a kid. But it was how you acted. Right. Because I think that was even with the case last week. Okay. So you got into the fight just because of beating your ass and for whatever reason you brought a knife into it. Everything you did after that point... Talks about who you are as a person.

And should we have you as a person out here roaming the streets? The answer is no. She killed a kid and was sitting there like she didn't care. No, you need to be locked up. And she had kids herself. No, you good where you at. And the fact that you can't sentence her more, the judge was doing everybody a favor by giving the max of what he could give because she didn't murder her. And that's what he said on her appeal. He was like...

Because he had to state why it was consecutive. And he was like, because your crime is so bad, you deserve more than one sentence. So you don't get to serve them together. Right. You deserve two terms of whatever I can give you. And I feel like, ooh.

sometimes the law is so black and white i know right because like vehicular homicide sometimes it's sometimes it really is an accident accident and i would take this but also it's how you react in an accident right like i've gotten into accidents where nobody was hurt but what do you do in an accident you get out you make sure everybody is okay that's the first thing you do that is i don't care if i tapped you are you okay come on now and couldn't be mean

All right, y'all. It is time for... I ain't do it. But if I did, this is how I would get away with it. I ain't do it. But if I did, I would be in that courtroom crying my eyes out on the floor begging for forgiveness. Like, I don't understand how somebody could just...

Keep it moving. Keep it moving. I would not be able to go to work. If I would have saw my car that fucked up... How am I supposed to focus the rest of the day? How do you do that? And if I would have hit her, I would have been on that scene. I would have been at the hospital. Oh, my gosh. What can I do? Take it all from me and give it to her. I don't have much, but you can have anything. And like you said, her mom was like, there was room for forgiveness because...

Accidents, right? Especially in the car. Vehicles are so dangerous, as is. Crossing the street is so dangerous, as is. But you did nothing. Again, that shows who you are as a person. And you as a person is so fucked up.

that's why you were sentenced consecutively that's why you deserve more time than what you got and that's why that mama's never gonna be able to forgive you she could have because she at least had the awareness she said it she at least had the awareness to know that shit fucking happens but you fucked up yeah and that's you to fuck and continue to fuck up and and wondering why we weren't mad at you looking at us like we wrong no no girl

Go ahead. How do you protect your child from somebody else doing something crazy? You don't. It's the most random thing that can happen. You can't even predict it. You can't. It's not like losing your child to the street. It's not like losing your child to some type of health ailment. Like, it's random. I remember in 2008, I was riding the bus to school.

And the middle school, their route was right in front of the high school route. And so we were riding up, and the middle school bus was stopped in front of us, and our high school bus was behind them. And, you know, the school bus signs, they stop, and it's a rainy morning. The school bus signs, they pull out for the stop, and it's the girls coming onto the bus. On the other side of the street, this armored truck was kind of speeding, and it slid on the rain.

And it ended up going up the curve and running the girl over. And her dad was there at the bus stop. And you just see him trying to push the truck off of her. And it's an armored truck, like the money truck. So it ain't no moving this bitch. And he's just sitting there trying to push it and push it. Oh, it was the worst day ever at school. Like, it was so quiet. Everybody was so sad. Her brother went to the school. Her brother was a quarterback. Everybody loved his family. Like...

It was tragic. I even have a cousin. My mom's cousin was killed when she, I don't know, between 9 and 13. She was riding bikes. And a lady ran her over and did not stop. And when they found her, her excuse was she was late to a wedding. And she died. Stacey died. And it fucked up her sibling. Her brother was right there, saw it, was riding the bikes with her. You don't know what that does to people, like...

How much you... Even when you're in the wrong, like, how much you can change the trajectory of everything. Like, choices have consequences, right? Like, every choice has a consequence. Like, her choice was to text on her phone. The consequence was that she hit desire. What do you do next? Right. What do you do next? I feel like it's not what you did in that heat of the moment. It's what you did thereafter. Mm-hmm. She has no integrity about herself. Like...

You're not a person that's, I'm no licensed psychologist, psychiatrist. I just do a little bit of research for this true crime podcast, you know, but sounds like a sociopath to me. Sounds like somebody that needs to be, have some serious, serious mental health checks. I just don't know how you could do it.

Parole or no parole? Girl, I think her release should be revoked. I think her release should absolutely be revoked. The sentencing is so poo-poo. And she's got three years of post-custody, what is it? Some light-ass parole. Barely parole. And she can't have a license, which didn't stop her the first time. Right! What good that did. And then when she violates again, what are y'all gonna do?

Give her a couple years. Another five years? Another five-year stint? No. Something needs to be changed about the laws on...

It's texting and driving, like drinking and driving. You get a DUI, so it's like an extra thing. So what is the extra thing for texting and driving? Because it's this big campaign around not texting and driving. We know that it's dangerous. We know that you shouldn't do it. I'm a horrible texter and driver. That's why I like now I've been spoiled by Apple CarPlay. I must have Apple CarPlay because that's how I'm going to text. If not, and if Siri be fucking up, I'll text you when I text you.

You remember when we were in Florida and we were going to something when you were coming to visit me in Florida and I was in my old car and the horn didn't work on my car and that person in front of us almost hit somebody crossing the street.
