that and a little bit SHE didn't know that not long after the game, a call would commit to nine one one on the other end was a voice full of fear.

At this point, the only story this family had heard boiled down to three simple words. JoNathan shot himself. And that simple story raised a lot of complicated questions. Could this really be suicide, or maybe something else altogether?
I concluded that branda must be wrong. There must have been in intruder in the house. That shirt JoNathan IT .
was just after midnight and a year's long search for answers was just getting started.
The family of JoNathan crews returned to their home in the small hours of the morning, reeling from the news of his apparent suicide. What are you thinking?

JoNathan on's close friend anny woke up that morning after the super bowl with a bad feeling. SHE begin a strange text from JoNathan. After the game, I plug my .

You ever been saying anything like that before? No, Emily says when he first saw the text, SHE didn't take IT literally. SHE thought maybe JoNathan was having a bad night or being dramatic. Now IT was morning and SHE hadn't heard from him again.
I think I tried to call his phone and he didn't answer. And I look at Jacobs said, you don't think something happened right? Like this is just so weird.
Emily decided to drive over the JoNathan s. Before he could get there. The family called Jacob with the a horrible nuts.
And then I got a phone call from jab. And all that I could make out that he was saying was JoNathan, his dad, and he's been shot .
pissed and confused, like, I don't like, how did you get shot? I don't even know where you got shot.
One thing he and everyone closed to JoNathan did know JoNathan was a gun enthusiasts and kept several firearms at his place. How many guns we have?

I didn't really like the guns i'd shoot with him. He was the one that first stop me to shoot.
Police determined the gun that killed JoNathan was indeed one of his own. Guns had been a part of his family's life for generations now. The entire family was in pieces.

for those early, no moments of grief. All anyone could think of was JoNathan, such a Young life lost who were a very .
close family. But he was kind of the ring leader for everything that happened.
He seemed to greet every day with that with an excitement for what was gonna en.

I met him in later nite grade. I kind of fall into the dirty group. And and when JoNathan came in, you know, he was tall, handsome and pretty athletic.
And he was a cool guy.
and he was a cool guy for a while. And then he kind of became friends with my group.
The best friends went on to be roommates at bailer university or JoNathan major red in history. After college, he wanted to save for grand school. So john athan, a snappy dresser who loved colorful neck tize work as a manager in the men's department at dealers. That's where he met Emily.
We had very similar personalities. We would always kind of joke that I was like the female version of him.
And at what point you guys very briefly went out.
So we went on one day, he asked me to go out to, like, dinner and drinks, midnight. And I look ago, you know, this would never work, right? He goes, yeah, I know we're pretty much the same person that would be weird for me to date myself.
And that was IT after that.

such good friends that JoNathan later played matchmaker me.
Jacob and JoNathan had gone out to drinks sweet night night. And jake of left and went to the bathroom. And I looked at john athan, I go, I think I like your friend because, okay, i'm cool with that. I'll help you. And then that night I think we kind .

Along with his tight circle of friends, much of JoNathan on's life started to revolve around this place. Wu I show in a martial art school in a couple strip mall, and IT became a family affair. JoNathan pain and danny all took classes there and practice come through.
There were a lot of social events, know, keep plugged out a lot. There were, you know, friendships and clicks .
made within schools. IT was there, danny first mp. Ara SHE was originally from mexico and a part time instruction at the marsh art school. You thought of brand as your best friend.
yes. SHE was one of the leaders in the school, and I I actually said to JoNathan, sometime, you know, this girl, brand a seems like a nice girl.

He came to me and said, I knows your best friend. Would you mind? And I did, in fact, mind, my one stipulation was, don't ruin my friendship with her. I don't come between .
us anything like JoNathan on. And Brenda began dating in november two thousand and thirteen. Sparks very quickly turned to fire, and branda told friend he saw JoNathan was the one. How was JoNathan who was a boyfriend, from what you could tell.

I would say, you know, he was a person that immersed himself fully into relationships.
Brenda seemed to be no exception. If SHE and jhn athan weren't together, they were constantly texting. Jain told his mom the relationship had become pretty intense. He said Brenda had gone through a rough childhood that he had trust issues and could be kind of insecure.
And so I said, why did you give a chance to see what it's like to be with a nice person? Because when he sees how loyal and wonderful you are should start to be a little more secure.
Three months into that horn wind of a romance, JoNathan decided to move out of his parents house and get his own apartment where they helped him pick. That plays out.
I believe SHE went around looking for some places, yes, and he was there. He helped to move SHE dim up embarks and cleaning supplies and cleaning everything .
out to his mom and dad. JoNathan seemed to be embarking on his next chapter. He had a new job, a new girlfriend, a new apartment. And so as they SAT crushed at the family home, the idea of suicide just didn't make sense.
I made a mental note of every area of his life. Everything was going so well in his life. And so I concluded that branda must be wrong. There must have been an intruder in the house that shot JoNathan, and he came in and found him that way and made an assumption.
Let me ask you this, which is not pleasant at any thought Johnson ever express any thoughts about taking his own life or hurting himself? no. Was he depressed? No possible that he was depressed or said, or miserable in some way. And you messed IT.
no. I actually think that JoNathan was in one of the best places that he'd ever been in in his life.
What happened in jahan's apartment that night? The only witness to this tragedy had a story to tell.
On the night JoNathan cruz died, capel police spoke with the only other person who was there. His girlfriend.
brando ZARA SHE was sitting .
on a stairs in the back, the apartment outside, and he was there, a police offers speaking to, and I walked up. That's what happened. And he basically said, go away.
And so if you want mind, just let me talk her for me. Then you can talk. Brenda began describing what happened that night .

I asked her what happened, and he said that they were having a conversation.

I think they had had a fight earlier that day, but he said that he was calm, he was having conversation, and then he said, i'm going to prove how much I love you. And then pulled out a gun and shot himself, and he fell back onto the bed.
Dani thought, brand, the story sounded strange. Who shoots themselves to prove their love for someone else? You thought this was an accident.
I figured that must be what I must be, an accident.
JoNathan on's dad was hoping police could provide some clarity.
I'm sure they asked me things like what he depressed in those kinds of things, although the thing that stands out is trying to impress upon me. Basically, we don't think this was a suicide, whatever the outcome is. Don't believe that what happened.
That was their big message.

Well, I assume they were. They had of some reason for that statement like he wasn't just to MIT me feel Better that they were facts that supported .

Sh'd been texting me asking if he could wear jeans and asking the address. And so when he just didn't show up, I was like.

JoNathan cruises family believe he never would have shot himself, at least not on purpose. And yet the more they thought about IT, the idea of an accident didn't fit either. JoNathan on's grandfather had taught him and his brother all about guns from childhood.

come back after they returned. Danny says IT wasn't long before brande's jealousy arrived like the new sheriff in town. Suddenly there were rules in this relationship, and JoNathan on's new job was to follow them.
At one point, he wished a happy birthday to a female friend on facebook that he didn't spoken to in years, and SHE freaked out bt about IT and wanted him to get rid of all of his fealty. Friends on facebook.

She's still thinking about that after he's dead.

He said that he'd been through a lot of traumatic things, and one of those being that her uncle was murdered in front of her by the car. Tel, and so, you know, her family had to flee mexico and they weren't allowed to go back. So I made her hard to trust people.

When I took the phone, SHE literally was like screaming at me.

I said to her, i'm sorry if that bothers you, that I hugged him, but he's my friend. I greet everyone that way. I'm not gona not hugged him because that bothers you. I'm not interested in him like it's never been like that.
I've never even kiss him.
No, SHE said a after wards, let me talk to my man. My man and I said, absolutely. And I handed Johnson than the phone.

to be honest. There was a little bit overwhelmed. I handed him the phone and got up from the table and went to the bathroom and immediately started crying.
When Emily returned to the table, JoNathan tried to apologize. He just kept and apologizing all over himself.
I said, like, I know that you like her. Like you're in a relationship with her. I don't want you to have to choose between your girlfriend and me. I just like right now, I don't want to be around her.
Emily didn't know IT at the time, but brand, this issues with her had been a sticking point in the relationship since that first dinner. And in part because of that, JoNathan had been thinking about ending the relationship a day earlier. He had said his sister danny, a text laying out his options, fight IT and try to make IT Better, which want to happen to chose branda. In other words, give up. He would beat me up.
Then the next morning, SHE heard JoNathan had been shot. Emmy's got told her something wasn't right. IT was a feeling SHE could not shake.
I thought, you know that he had done something to him. I knew john athan. I knew that he wouldn't have done this.
So then what about that text Emily received from JoNathan after the super bowl? I wants to die. yeah.
Did he talk that way? No, no. China's than when he gets stressed out. You know what I used to live him and and what I know about, he just go sleep, him texting, just that one little thing would have made since he would have said nothing at all, or he would have colder.
Emily and jacket turned IT over and over in their minds. You now do not believe JoNathan sent that text. No, you think this is that after he dies.

A year earlier, he'd been prescribed the anti anxiety medications anax, but told his family he only took one pill and never refiled the prescription. Any evidence that he was under psychiatric care or was on any kind of any depression?
There was no evidence.
As shila worked, the family filed their civil lawsuit against brender, seeking more than a million dollars in damages and asking for a jury trial. My expert of opinion, JoNathan creeds, could not control his shoulder across his body, and in that such manner, in order to manuvre the weapon, in order to make the shot in to his own chest, without pushing to a bizarre out of pain when he could have just stood up, put the weapon to is his head in his mouth, under his chain, or squarely into his heart. The family's attorneys told the jury about those gunshot residue tests showing branda had g, sr. On her switcher and both their hands.
And they argued that, well, JoNathan had no motive to kill himself. Branda did have a motive. JoNathan was about to break up with her. Emily testified to how angry Brenda had been on the day of JoNathan on's death.
I spoke her on the phone on the day .

If you're going to break up with someone, you don't order dinner for two at eight o'clock at night and haven't spent the night, that just doesn't make any a sense.

his own life, I underestimated how important this was to my daughter, to Johnson, to friends, even to my wife. A criminal trial, a criminal trial.
The thing I really wanted was for JoNathan to be indicated. He's not here to speak himself. He didn't kill himself.
We strongly believe that he, he killed him.
We spoke with jury forman edy Brown. He told us jurors pretty much agreed. Brenda was the shooter before they even took their first vote.
The biggest thing that let us to our decision was the trajectory of the bullet. Every one of us in the jury attempted to recreate the angle of what the bullet would have went through, where he had hold the gun in whether there was an accident on his partner. Now that seemed extremely unlikely. We couldn't recreated.
And as for that lower standard of proof in a civil trial, the form and told us managers thought the evidence was so strong against Brenda, they believe he was responsible beyond a reasonable debt. Could you have voted to lock up branda instead of a financial award? Yes, you didn't have any problem with that. No, not at all. Did anyone wonder why this was in civil .

with the criminal case. JoNathan on's parents hoped a win in civil court mightly to criminal charges that did not happen five months after the civil verdict, the dallas district attorney invited them to a meeting and said there was insufficient evidence to proceed.
They made a presentation that suggested that the video that we had made was incorrect and that we had misrepresented the facts to the jury.
We asked the days of us what facts they were talking about. They said, unlike what's shown in the animation, they couldn't draw a reliable conclusion about the bullet trajectory based on the evidence. That's because when police went looking for where the bullet ended up, they took apart JoNathan on's bad and the da things the bullet could have rolled around.
In the process, we wanted to know what else police did or didn't do. They declined to answer our questions, so we requested their case file and obtain some records that neither side in the civil trial ever saw. First, what's missing? There's no photo of the gun near JoNathan on's body.

get even for, yeah, he did all out of IT. That's right. The first officer on scene picked up the gun and moved IT from the bedroom to the kitchen, disturbing a key piece of evidence.
And according to records we examined, there was something else. Police did not have fingerprints. They waited six months to test the gun for them. By that time, I had been sent to a lab and swapped for DNA, possibly wiping away usable prints. The crime lab did find unknown DNA on a gun along with JoNathan, than except there is no record of police getting a DNA sample from brand to compare .

envelope labeled DNA saml from Brenda a was sent to the lab, but IT turned out to be a swab of JoNathan on's blood of her hands. I know this is hard, okay, but I have to ask these questions. All right.
That night, Brenda was questioned by police for more than two hours. The story he told police was consistent, some questions to try, catch and why, and things match. Even so, her story still raised a lot of questions.
But you see how this doesn't make sense.
IT did not make sense to me at all.
To this day, former prosecutor mike snapp ed thinks police could have done more, and he says he was willing to take a case against brendel ZARA before a jury in criminal court. Was this disappointing.

Brand's atterley says the fact Brenda was never charged is the whole point. SHE wasn't charged because she's innocent of any crime.
She's been hounded now for nine years over this. And SHE would really like to put this experience behind her and and move forward.
