Today we're bringing you the Supreme Court of Canada's Majority decision in R v Barton. This case, which is currently (as of today's date, Jan 20, 2021) back at trial, involved complex facts and issues at each level of the decision. At the SCC, the main discussion concerned Section 276 evidence and post-fact conduct. Before Karly takes you through the decision, Zach and Karly chat the broader context, 276 evidence, and the historic (and current) mistreatment of Indigenous people by the justice system.
CW: This case is about the sexual assault and murder of an Indigenous woman in Alberta. If this content is not for you, please choose another episode. Take care when listening.
